Gilbert Town Code Chapter 14, Article III (Short-Term Rentals), approved by the Town Council in June 2023, makes it unlawful to operate a short-term rental in Gilbert without a current Town STR License. Applications are filed through Gilbert's GovOS/MuniRevs portal. Required items include: a $100 non-refundable license fee ($100 annual renewal); proof of an active Arizona Transaction Privilege Tax (TPT) license issued by the Arizona Department of Revenue; proof of liability insurance with an aggregate of at least $500,000 (or use of an online lodging marketplace that provides equivalent coverage), as required by A.R.S. Β§ 9-500.39; the name and 24/7 phone number of an emergency contact who can respond to complaints; and an attestation that the applicant is not a registered sex offender. Within 30 days of license issuance, the owner must mail written notice of the emergency contact to all single-family properties adjacent to and directly or diagonally across the street from the rental. Operating an STR in Gilbert without a current Town license, lapsed insurance, or expired TPT license is a civil violation of Chapter 14, Article III. State law (A.R.S. Β§ 9-500.39) authorizes escalating fines up to $500 (1st), $1,000 (2nd) and $3,500 (3rd) per verified violation, plus possible TPT license suspension by the Arizona Department of Revenue.
