Driveway and private-property parking in Milpitas is governed by Section V-100-10.14 of the Municipal Code, which states that no person shall park a vehicle in a private driveway or on private property without the direct or implied consent of the owner or person in lawful possession. Under Section V-100-10.14-1, an owner may cause removal of an unlawfully parked vehicle, consistent with California Vehicle Code Section 22658, only when signs prohibiting public parking are posted in plain view at all entrances; those signs must be at least 24 inches wide and 18 inches high, list the Police Department's business phone number, and state that vehicles will be removed at the owner's expense. Section V-100-10.14-2 requires the owner arranging a tow to provide, on request, the towing company's name and the time it was called; if a tow truck has not arrived within 45 minutes, the Police Department may cancel the tow and cite the vehicle owner. Section V-100-10.02 separately prohibits stopping, standing, or parking within a parkway, the area between the curb and sidewalk. Blocking a driveway on the public street is controlled by state law (California Vehicle Code Section 22500(e)). The 18-inch curb rule in Section V-100-10.05 applies to the adjacent street, not the driveway itself.
