Milpitas does not impose a citywide overnight street-parking ban; the old all-night prohibition was repealed in 1975. Overnight parking is allowed subject to the 72-hour limit and any posted signs. Commercial vehicles, however, are barred overnight (9 p.m.-6 a.m.) on streets where signs are posted.
Unlike many cities, Milpitas has no general overnight residential parking ban. Former Section V-100-12.03, which prohibited all-night parking, was repealed by Ordinance 43.89 in 1975 and remains repealed in the current code. As a result, passenger vehicles may legally park overnight on most public streets, subject to the 72-hour maximum in Section V-100-10.03 and any posted time-limit, permit, or no-parking signs. The principal overnight restriction is on commercial vehicles: Section V-100-12.10 provides that where authorized signs are posted, no person shall stop, stand, or park any commercial vehicle between 9:00 p.m. and 6:00 a.m. on the affected street, except briefly to load or unload as allowed under Section V-100-11.03. The City may also designate streets where commercial vehicle parking is prohibited at all hours (Section V-100-12.12), and may establish permit-only residential parking zones (Section V-100-12.14) and time-limited zones (V-100-12.01). Tall vehicles (six feet or higher) face additional limits near intersections under Section V-100-12.15. Drivers should always confirm there are no posted overnight, permit, or street-sweeping restrictions on their block.
