Fort Myers regulates EV charging primarily through building permits and the adopted state codes rather than a standalone city ordinance. Residential Level 2 (240V) chargers and commercial charging stations require an electrical permit from the City of Fort Myers Permitting Division (for addresses within city limits) or from the Lee County Department of Community Development Building Services (for unincorporated addresses); applications and payments for Lee County permits run through the eConnect online system. All installations must comply with the 2023 Florida Building Code, 8th Edition, which took effect December 31, 2023, and with the National Electrical Code as adopted in Florida. The Florida Building Code's EV-related provisions require new and substantially renovated commercial and multifamily construction to provide a defined percentage of EV-capable, EV-ready, or EVSE-installed parking spaces, scaled to the use and parking count, with conduit and panel capacity sized for future Level 2 charging. At the state level, Florida Statute 366.94 makes it 'unlawful for a person to stop, stand, or park a vehicle that is not capable of using an electrical recharging station within any parking space specifically designated for charging an electric vehicle'; violations are noncriminal traffic infractions punishable under FS 316.008(4) or 318.18.
