Unincorporated Modoc County has no ordinance banning overnight parking on county roads, and no 2 a.m.-6 a.m. restriction in its code. Overnight parking is generally allowed unless a vehicle violates the statewide 72-hour rule or sits in a posted no-parking zone. State law lets counties add overnight limits only with posted signs.
Modoc County's Title 10 traffic code contains no general overnight-parking prohibition for unincorporated areas, and no adopted 2 a.m. to 6 a.m. restriction. As a result, parking a vehicle overnight on a county-maintained road is generally permitted. The main statewide limit is California Vehicle Code Section 22651(k), which allows a vehicle left standing on a highway for 72 or more continuous hours to be cited and removed - so a vehicle parked night after night in one spot can be tagged once it exceeds three days. Under California Vehicle Code Section 22507.5, a county may by ordinance or resolution prohibit parking between 2 a.m. and 6 a.m., but such a restriction takes effect only after signs giving adequate notice are posted; Modoc County's code does not currently include such a blanket overnight ban. Localized exceptions still apply: posted no-parking areas under Chapter 10.12 and the height-restricted zone near the Canby fire station under Section 10.12.030 are enforceable at all times where signed. Drivers in the snow-prone Alturas, Cedarville, and Adin areas should also watch for any winter no-parking signs posted by Public Works during plowing.
No county overnight-parking fine exists. A vehicle parked in the same spot beyond 72 hours may be cited and removed under California Vehicle Code Section 22651(k). Parking in a posted no-parking area (Modoc County Code Chapter 10.12) or the signed height-restricted zone near the Canby fire station (Sec. 10.12.030, a misdemeanor) is enforceable whenever signs are present.
