Ground-level patios (concrete slabs, pavers) at or below grade typically do not require a permit unless they involve drainage modifications. Covered patios, pergolas, and screen enclosures require permits and must meet HVHZ wind-load requirements. Setback requirements apply β typically 5-7.5 feet from property lines. Guardrails at least 42 inches high are required where decks are more than 30 inches above grade. Screen enclosures are very popular in South Florida and have specific permit requirements.
Unpermitted decks or patio structures face fines of $250-$500 per day. Structures not meeting HVHZ wind-load requirements may be ordered removed for safety.
