The Town of Oro Valley does not require a permit for residential garage, yard, or estate sales. However, sales are limited to no more than four per calendar year at any single address, with each sale lasting no more than three consecutive days. Sales must operate during daylight hours, typically 7 AM to sunset. Merchandise must be displayed on private property only -- not in the street, on sidewalks, or in the public right-of-way. Signs advertising the sale must comply with the Town sign code and cannot be placed in public rights-of-way or on utility poles. After the sale, all unsold merchandise and signs must be removed promptly. Operating a continuous or frequent sales operation may be classified as a commercial business requiring a home occupation permit and business license. Many Oro Valley HOAs restrict garage sales to community-wide designated weekends, typically held two to four times per year, and prohibit individual sales outside those dates.
Exceeding the four-sale annual limit or operating a continuous sales business may result in code enforcement action and require a business license. Signs in the right-of-way are removed without notice.
