Vacant lot owners in Oro Valley are responsible for maintaining their properties to prevent nuisance conditions. This includes removing accumulated trash, debris, and construction materials; controlling weed and brush growth that exceeds 12 inches in height or creates a fire hazard; preventing erosion and illegal dumping; and maintaining any existing fencing or walls in safe condition. Lots in the wildland-urban interface areas near the Catalina Mountains and Pusch Ridge may be subject to additional fuel management requirements. The Town does not require full landscaping of vacant lots but does require that the natural desert condition be maintained without allowing invasive species or accumulated dead vegetation. Vacant lots that attract illegal dumping or become harboring sites for vermin may be declared nuisances. The Town may enter and abate the nuisance condition, with costs assessed as a lien against the property. HOA-governed vacant lots must also comply with association landscaping and maintenance standards, which may require dust-free surface treatment or native plant establishment.
Written notice is provided with a 30-day compliance period for most violations. Unresolved violations result in fines up to $2,500 per day. The Town may abate hazards and lien the property for costs.
