Passaic County sets no vacant-lot maintenance code. New Jersey municipalities regulate weeds, debris, and overgrowth on vacant lots under their local property-maintenance ordinances and the state Abandoned Properties Rehabilitation Act.
The County of Passaic does not maintain a vacant-lot ordinance. Under New Jersey home rule, each municipality (Paterson, Clifton, Passaic, Wayne, West Milford and the other boroughs/townships) requires owners to clear brush, weeds, and debris and may abate and lien the property if the owner fails. Vacant and abandoned lots can also be placed on a municipal abandoned-property list under N.J.S.A. 55:19-78 et seq. County involvement is limited to Planning Board review of subdivisions affecting county roads or drainage (N.J.S.A. 40:27-6.2).
Municipal fines apply; towns may abate overgrowth and place a lien for the cost of cleanup on the owner under local ordinance and N.J.S.A. 40:48-2.13/2.14.
