San Clemente adopts the 2018 International Property Maintenance Code by SCMC 8.78.010, amended so all developed properties must stay free of dead or dry weeds and live weeds exceeding one inch, with noxious weeds prohibited.
The City adopted the International Property Maintenance Code (IPMC) 2018 Edition by reference in SCMC Section 8.78.010. As amended in SCMC 8.78.040, IPMC subsection 302.4 (Weeds) requires that 'All developed properties shall be maintained free from dead, dry weeds and live weeds in excess of one (1) inch,' and 'All noxious weeds shall be prohibited.' Separately, the nuisance chapter declares overgrown vegetation likely to harbor rats or vermin, or dead, decayed, diseased trees and weeds constituting unsightly appearance or danger, to be public nuisances (SCMC 8.52.030(G)-(H)). Vacant and improved lots must also be kept clear of grass and weeds under SCMC 8.76.040. The City runs an annual weed-abatement program clearing non-compliant parcels and billing owners.
Weed violations on developed property are enforced by the Code Compliance Division under the adopted IPMC (SCMC 8.78). On lots, non-compliance after a Notice to Clean triggers City abatement and a weed-and-cleaning tax lien plus 25 percent (SCMC 8.76.110).
