SCMC Section 8.52.030(N) lists 'garbage cans stored in front or side yards and visible from the public right-of-way' as a declared public nuisance. Reinforcing this, the Solid Waste Management chapter (SCMC 8.28.040) requires that within 24 hours after collection, all containers be removed and placed so they are 'substantially hidden from view from any public street or alley.' The code defines 'substantially hidden' to mean each container is behind a permanent wall, fence, or similar structure not less than the height of the container. Containers may be set out no earlier than 5:00 p.m. the day before collection. These rules apply to the trash, recycling, and organics carts provided by CR&R Environmental Services.
Cart-storage violations under SCMC 8.28.040 may first draw a warning sticker or mailed notice, but the City may cite without warning. Penalties under SCMC 8.28.210(C) are $50, $75, then $100, issued as administrative citations under Chapter 1.20.
