Edison's enforcement against loud parties does not depend on a stand-alone 'loud party' or 'social host' ordinance - the conduct is reached by general provisions that have broader application. Chapter 10 (Police Regulations) of the Edison Code, as published on eCode360, includes the long-standing prohibition: 'No person shall make, aid, assist in any riot, breach of peace or disturbance, or be guilty of any disorderly conduct, or open drunkenness, or drink intoxicating liquors in the open streets or highways of the Township or other quasi-public open places in the Township, nor shall any person utter loud, offensive or indecent language in the streets or highways or in other public or quasi-public places of the Township, nor shall any person make improper noise, utter loud, offensive or indecent language on private property so that the same is audible to the public beyond the confines of the private property.' That sentence is the workhorse against backyard parties, garage music, and street-side gatherings that spill out of a private residence. Chapter 12 Β§12-27 (the NJDEP-approved noise ordinance, approved December 20, 1991) supplies the decibel limits - 50 dBA at receiving residential property lines between 10 p.m. and 7 a.m., 65 dBA daytime - and Β§12-27.7 supplies the weekend 9 a.m. to 8 p.m. activity restriction. Edison Police respond to active disturbances and may issue Chapter 10 disorderly-conduct summonses, Chapter 12 Β§12-27 noise summonses, or both. New Jersey's separate state statutes on underage drinking (N.J.S.A. 2C:33-15) and providing alcohol to a minor (N.J.S.A. 2C:33-17) apply on the same call and are not displaced by the local framework. Edison has not adopted a 'social host' civil-liability ordinance imposing strict liability on the host for guest noise or underage drinking; civil liability for serving alcohol to a visibly intoxicated guest or to a minor runs under the New Jersey Dram Shop Act and the common-law social-host doctrine articulated in Kelly v. Gwinnell. Repeated calls at a registered rental are reported back to the Edison Division of Health and the Township Clerk for consideration at Chapter 17 license renewal.
Chapter 10 disorderly-conduct and disturbance violations carry the Chapter 1 Β§1-5 penalty schedule in Edison Municipal Court, typically a fine of up to $2,000 and/or community service or up to 90 days imprisonment in the standard New Jersey municipal-court range. Chapter 12 Β§12-27 noise violations carry the chapter's first-offense range of $25-$250 and a $200 minimum on subsequent offenses.
