Two regulatory layers govern outdoor smoking in Edison. First, statewide, the New Jersey Smoke-Free Air Act at N.J.S.A. 26:3D-55 et seq. (as amended by P.L. 2009, c. 182 to add electronic smoking devices and by later amendments to add Edward J. Bloustein School-related restrictions) prohibits smoking in nearly all indoor workplaces, indoor public places, public transportation, and certain outdoor settings - in particular, on the property of any public or nonpublic elementary or secondary school, and at any park, beach, or recreation area owned by the State of New Jersey (under the 2018 amendment effective January 16, 2019). Second, at the local level, Edison Council adopted a Township ordinance banning all smoking - tobacco or cannabis, combustible or vapor - on Township-owned or Township-leased outdoor properties, including public parks, playgrounds, ball fields, parking areas, driveways, and drive aisles. The ordinance was introduced at the Council meeting of March 23, 2022 and adopted thereafter; it is enforced by the Edison Health Division, the Edison Police Division, and the Recreation Division as appropriate to the property and the violation. The ordinance penalty schedule is uniform: $250 for a first offense, $500 for a second offense, and $1,000 for each subsequent offense, with each act of smoking deemed a separate offense. The ordinance reaches recreational and medicinal cannabis smoke equally (the 2021 New Jersey adult-use cannabis law at N.J.S.A. 24:6I-31 et seq. authorizes cannabis use but does not preempt local restrictions on public smoking). Private outdoor property - the patio of an Edison home, a private restaurant patio not open to the public for service, the driveway of an apartment building not leased to the Township - is outside the local ordinance and is governed only by the Smoke-Free Air Act's indoor-migration rule at N.J.A.C. 8:6 (which prohibits outdoor smoking where the smoke migrates into an adjacent indoor public place where smoking is prohibited).
Smoking on Township-owned or Township-leased outdoor property in Edison is enforceable on a $250 / $500 / $1,000 escalating-fine schedule under the local ordinance, with each act of smoking a separate offense. Enforcement is split between the Edison Health Division (parks and playgrounds in particular), Edison Police on patrol, and the Recreation Division for ball-field and event-site violations. Statewide Smoke-Free Air Act violations carry the N.J.S.A. 26:3D-64 penalty of not less than $250 for a first offense, $500 for a second offense, and $1,000 for each subsequent offense - the same numbers as the Edison local schedule, which is why Council chose those figures for alignment. Employers and operators who knowingly permit prohibited smoking face their own employer-penalty exposure under the Smoke-Free Air Act.
