Smoking, vaping, or ingesting cannabis in any public place, park, or vehicle on public roads is illegal in Orange County under Proposition 64 codified at Health & Safety Code Β§11362.3, even for adults 21 and over.
Prop 64 legalized recreational cannabis for adults but expressly banned consumption in public spaces. Health & Safety Code Β§11362.3 makes smoking or vaping cannabis a $100 infraction in public, with steeper penalties near schools, daycares, or youth centers (up to $250). OC Parks bans all cannabis use. Driving while consuming or open cannabis containers in vehicles violates Vehicle Code Β§23222(b). Licensed consumption lounges authorized by AB 1775 are not currently permitted in unincorporated OC; check city ordinances if inside an incorporated city. Edibles are subject to the same public-use prohibition.
