Although Oregon legalized recreational cannabis under Measure 91, public consumption remains prohibited statewide under ORS 475C.341, with civil penalties enforceable on Portland streets, parks, and sidewalks.
Oregon Measure 91 (2014) legalized adult recreational cannabis, but ORS 475C.341 still bars consumption in any public place, including Portland sidewalks, parks, transit, and parked vehicles on public streets. Portland Parks rules under PCC Title 20 reinforce the ban inside parks. Smell-only enforcement is rare, but officers may issue citations when consumption is witnessed. Apartment renters should also note that landlords may prohibit cannabis use in private leases. Federal property such as Forest Park trail segments owned by federal agencies retains a complete federal prohibition.
Smoking, vaping, or eating cannabis in any public place can result in a Class B violation citation, parks exclusion, or, on federal land, federal prosecution under the Controlled Substances Act.
