Oregon Measure 91 (2014) and its codification at ORS 475C.341 prohibit consuming cannabis 'in a public place' anywhere in Oregon, including Portland. Smoking cannabis is also banned in workplaces and within 10 feet of entrances under the Indoor Clean Air Act (ORS 433.835) as amended by ORS 433.847. Portland enforces these via PCC 14A.50.010 (controlled substances on public property).
Although Oregon voters legalized adult-use cannabis through Measure 91 in 2014, the same measure -- now codified throughout ORS Chapter 475C -- prohibits public consumption. ORS 475C.341 makes it unlawful for a person 21 or older to consume marijuana items 'in a public place.' 'Public place' is defined at ORS 433.835 to include any place open to the public, such as streets, sidewalks, parks, restaurants, public transit, and the open areas of bars and businesses. Smoking cannabis is additionally prohibited indoors and within 10 feet of workplace entrances, windows, and vents under the Indoor Clean Air Act (ORS 433.835-875), which the 2016 legislature amended (ORS 433.847) to cover inhalant delivery systems and 'cannabinoid products.' Portland enforces public consumption via PCC 14A.50.010, which prohibits consumption of any 'controlled substance, as defined in ORS 475.005' on public property. Violation of ORS 475C.341 is a Class B violation with a maximum fine of $1,000 (ORS 153.018). Onsite consumption at cannabis retailers is also prohibited; Oregon does not currently license cannabis lounges. Vehicle consumption is separately illegal under ORS 811.481.
Smoking, vaping, or consuming cannabis in any Portland public place violates ORS 475C.341 (Class B violation, fine up to $1,000) and may also be cited under PCC 14A.50.010 (Class B misdemeanor). Cannabis use within 10 feet of a workplace entrance violates ORS 433.840 with a $50-$500/day penalty. Consuming cannabis in a motor vehicle is a separate offense under ORS 811.481.
