Outdoor smoking in Portland is governed primarily by Oregon's Indoor Clean Air Act (ORS 433.835 to 433.875), which prohibits smoking and vaping within 10 feet of any entrance, exit, opening window, or air-intake vent of a workplace. Multnomah County parks (managed by Portland Parks & Recreation under PCC 20.12.080) are entirely smoke-free. There is no general citywide outdoor smoking ban on sidewalks.
Oregon's Indoor Clean Air Act (ICAA), codified at ORS 433.835 to 433.875, was expanded in 2009 to include the 10-foot outdoor buffer and again in 2016 (ORS 433.847) to cover inhalant delivery systems such as e-cigarettes and vape pens. The law prohibits smoking, aerosolizing, or vaporizing of inhalants within 10 feet of: any entrance or exit of an enclosed workplace, any opening window, and any air-intake vent. Employers must post 'No Smoking' signs and may designate a compliant outdoor smoking area outside the 10-foot zone. Enforcement is by the Oregon Health Authority (OHA); complaints go to 1-866-621-6107 or an OHA online form. Civil penalties under ORS 433.990(5) range from $50 to $500 per day per violation. Separately, Portland Parks & Recreation prohibits smoking in all city parks, natural areas, and trails under PCC 20.12.080 ('Conduct in Parks'); violation is a Class C misdemeanor with a fine up to $500. Portland has not enacted a citywide outdoor smoking ban on public sidewalks or streets, though smoking is restricted in TriMet bus and MAX stops under TriMet code. Cannabis use in public is separately prohibited by ORS 475C.341 (see public-marijuana-use).
Smoking within 10 feet of a workplace entrance violates ORS 433.840 and can result in civil penalties of $50 to $500 per day under ORS 433.990(5), enforced by OHA. Smoking in a Portland park violates PCC 20.12.080, a Class C misdemeanor with a fine up to $500 and possible park exclusion. Smoking inside any enclosed workplace is a separate ICAA violation with the same penalty range.
