Brookhaven's STR ordinance (Chapter 27, Β§27-629) does not set a fixed citywide cap on overnight or daytime guests. Each permit application must state the unit's bedroom count and the operator's proposed overnight and daytime occupancy limit, which becomes binding on that permit. STRs are also capped at 180 rental days per calendar year and at 5% of residential parcels per council district.
Brookhaven regulates short-term rentals under Chapter 27, Section 27-629 of the Code of Ordinances, last amended by ORD2025-02-03. The application requirements (Β§27-629(3)(b)) require each applicant to identify the number of bedrooms in the unit and the applicable overnight and daytime occupancy limit for the unit. Brookhaven's code does not impose a uniform person-per-bedroom standard; instead, the operator's stated limit is reviewed by the City and, once approved, governs that specific permit. Combined with the 180-day annual rental cap, the 5% per-council-district parcel cap, the homestead-exemption requirement, and the one-year prior-ownership requirement, the per-permit occupancy figure is a meaningful enforcement metric: exceeding it counts as a violation, and two violations within a single year disqualify the permit from renewal. Operators should also note that all guests are subject to Brookhaven's noise ordinance (Chapter 16, Article VII) and parking rules, and that occupancy disputes typically begin with a complaint to Code Enforcement at 404-637-0500.
Renting to more guests than the approved occupancy limit on the permit, or operating without a valid STR permit, is a code violation. Two violations of any STR rule within a single year result in the permit being denied renewal under Β§27-629.
