Brookhaven Code Β§27-629(3)(b)(8) requires every STR applicant to submit "proof of insurance for the property to be used as a short-term rental" with the permit application. The ordinance does not specify a minimum liability dollar amount, but standard homeowner policies often exclude commercial lodging β most operators carry a dedicated short-term rental or commercial host policy plus the platform's host protection.
Brookhaven's STR ordinance (Chapter 27, Section 27-629, as amended by ORD2025-02-03) requires applicants to provide proof of insurance for the property being used as a short-term rental as part of the application package (Β§27-629(3)(b)(8)). The ordinance text does not prescribe a specific minimum liability coverage amount or policy form. Because most standard homeowner policies (HO-3) exclude business activities and commercial lodging, operators commonly meet this requirement with a dedicated short-term rental endorsement, a commercial landlord/host policy, or a hybrid product from carriers like Proper Insurance, Slimsey, or CBIZ. Platform-provided coverage (Airbnb AirCover up to $1M; Vrbo Liability Insurance up to $1M) supplements but typically does not replace owner-side coverage, and Brookhaven's permit reviewer evaluates whatever proof is submitted. Operators should also note that the 2025 amendments added record-keeping obligations: hosts must maintain records of guest stays, dates, guest counts, costs, and taxes for two years following the calendar year of the stay.
Failing to maintain proof of insurance during the permit term, or submitting false documentation, is grounds for permit revocation or non-renewal under Β§27-629. Two violations of any STR provision within a single year result in non-renewal.
