Fairfax County requires a Short-Term Lodging (STL) Zoning Permit before advertising or operating any rental of less than 30 days. Permit fee is $270, valid 2 years. Property must be operator's primary residence (β₯185 days/year). Cap of 60 rental nights per calendar year.
Operators must apply through the county's PLUS portal. Requirements include proof of primary residency, a floor plan, a signed compliance affidavit, and designation of an authorized agent (different from operator) who is available during all stays. STL is prohibited in detached accessory structures, accessory living units, affordable dwelling units, and workforce dwelling units. Events or gatherings beyond the renting guests are prohibited. Applications take approximately 14 calendar days. Permit number must appear in all online listings. Platforms such as Airbnb collect and remit TOT to the county under VA Code Β§58.1-3826.
Operating without a permit is a zoning violation subject to code enforcement. Permit revocation possible for repeated violations.
