Gardena regulates signs under Gardena Municipal Code Chapter 18.58 in a content-neutral, viewpoint-neutral manner consistent with the free-speech provisions of the U.S. and California constitutions. Residential properties may display an unlimited number of noncommercial signs, including political and religious messages, subject only to objective size, height, and placement limits.
GMC 18.58 states the city's policy to regulate signs consistent with the First Amendment and to treat noncommercial messages content-neutrally; any noncommercial message may be substituted for any allowed sign without additional permitting. On residential uses, noncommercial message signs (expressly including political and religious messages) are unlimited in number, with a cumulative area determined under 18.58.030.B and a 5-foot maximum height and 5-foot setback for freestanding signs. During the window beginning 45 days before a general or special election and continuing until 3 days after the election, the allowed cumulative sign area may be increased by an additional 4 square feet. The chapter contains an express noncommercial-substitution clause so that political speech is never disadvantaged relative to commercial signage.
Signs exceeding the size or height limits, placed in the public right-of-way, or left up long after an election may be cited and removed by the city with cost recovery.
