Political signs are protected speech. Lubbock allows residential political signs without a permit subject to TX Election Code and Reed v. Town of Gilbert content-neutrality limits. HOAs cannot prohibit them under TX Election Code 259.002.
Political signs are treated as a category of temporary noncommercial speech. Under Reed v. Town of Gilbert (2015), cities cannot impose stricter size or duration rules on political signs than on other temporary signs. Lubbock residential temporary sign rules generally permit signs up to 8 square feet in residential zones and up to 36 square feet on commercial property, without permit. Signs may not be placed in the public right-of-way or on utility poles. Texas Election Code Sec. 259.002 preempts HOA restrictions on political signs from 90 days before through 10 days after an election, allowing signs up to 4 by 6 feet (36 sq ft) and 8 feet tall. Signs may not be illuminated, include audio, or be attached to HOA property.
Signs in right-of-way are removed without notice. Oversized or illuminated signs receive correction notice then citation.
