Senate Bill 1383, codified at Public Resources Code 42649.8 onward, mandates 75 percent reduction of statewide organic waste by 2025 from 2014 levels. Tier 1 commercial generators in San Bernardino County, including supermarkets and large food service operators, must subscribe to organic waste collection service or self-haul to a permitted composting facility. Although not a direct ban on plastic clamshells, SB 1383 makes compostable fiber containers the practical choice when organics service is required. Burrtec, Athens, and Republic Services run the main commercial organics routes across the Inland Empire and high desert.
Failure to subscribe to organic waste collection service or contaminating organics with plastic foodware can result in fines up to 500 dollars per violation per day after warnings.
