Mililani Town is one of Oahu's most HOA-dense communities, with the Mililani Town Association, Mililani Mauka HOAs, and multiple sub-association boards managing CC&Rs. HRS Sec. 196-7 voids any CC&R provision that prevents solar installation on covered homes and prohibits HOAs from charging solar-specific fees. HOAs may impose reasonable aesthetic guidelines but cannot reduce system efficiency by more than 25 percent or increase cost by more than 15 percent. No Honolulu ROH provision supplements this. Owners should submit architectural review applications with layout, conduit route, and color specs, and retain the statutory efficiency/cost calculations in case of dispute with the design committee.
HOAs that enforce void restrictions face civil exposure from homeowners. Reasonable guidelines within the statutory limits remain enforceable.
