New York Statewide Pool Barrier Requirements

The New York State Uniform Fire Prevention and Building Code, adopted under Executive Law Article 18, incorporates Appendix G of the Residential Code requiring barriers around residential swimming pools, spas, and hot tubs. Barriers must be at least 48 inches high, with maximum 4-inch openings, self-closing and self-latching gates opening outward, and latches at least 54 inches above grade. Pools deeper than 24 inches require approved barriers, alarms on doors leading to the pool area, or approved safety covers. The Uniform Code applies to every city, town, and village statewide except New York City, which has its own equivalent code.

Violations of the Uniform Code may result in stop-work orders, civil penalties up to $1,000 per day per violation under Executive Law 382, and refusal of certificates of occupancy by local code enforcement officers.
