Avondale's zoning rules apply to 'all permanent or non-permanent pools' more than 18 inches deep, so above-ground pools are regulated. Setbacks under Sec. 28-136 apply, and the state enclosure law (A.R.S. 36-1681) plus the adopted 2024 ISPSC govern barriers.
Avondale Zoning Ordinance Section 28-136(f) provides that the pool regulations apply to 'all permanent or non-permanent pools containing water with a depth of more than eighteen (18) inches,' which brings above-ground and portable pools within the same rules as in-ground pools. That means an above-ground pool may not be located in a required front yard (Sec. 28-136(b)) and must observe the property-line setbacks: in Suburban and Urban Residential Districts a private pool may not be closer than three feet to any property line (Sec. 28-136(c)), and in other residential districts a private or semi-public pool may not be closer than seven feet to any property line (Sec. 28-136(d)). The enclosure standard still applies under Sec. 28-136(a), which defers to A.R.S. 36-1681, requiring a five-foot barrier with self-latching gates. Because the pool walls of an above-ground structure can themselves serve as part of the barrier under the state statute and the adopted 2024 International Swimming Pool and Spa Code, owners should verify with Building Services whether additional fencing or a removable/lockable ladder is needed. A building permit may also be required depending on the size and installation type; contact Building Services at (623) 333-4000 to confirm.
Placing an above-ground pool in a front yard or within the setback, or operating without a compliant barrier, violates the zoning ordinance and state enclosure law and can trigger code enforcement.
