Avondale Zoning Ordinance Section 28-136(a) states plainly that 'swimming pools shall be enclosed in accordance with the provisions of state law,' deferring the enclosure standard to Arizona Revised Statutes 36-1681. That statute applies to pools and contained bodies of water 18 inches or more in depth and wider than eight feet. The barrier must be at least a five-foot wall, fence, or other barrier measured on the exterior side, with no openings through which a spherical object four inches in diameter could pass, and it must be located at least 20 inches from the water's edge. The barrier may not contain handholds or footholds on the exterior that allow climbing. Gates must be self-closing and self-latching, open outward away from the pool, and have the latch located at least 54 inches above the ground (or be secured by a padlock). Because Avondale has also adopted the 2024 International Swimming Pool and Spa Code, additional barrier details (such as for doors and windows facing the pool) are enforced through that building code. A.R.S. 36-1681 includes exemptions, including pools at residences where all residents are at least six years of age, but Avondale's adoption of the ISPSC means the building code's barrier provisions also apply.
Failure to maintain a compliant pool barrier violates state law and the adopted building code and can result in code-compliance enforcement and, under A.R.S. 36-1681, a civil or criminal penalty for non-compliance.
