Prefabricated above-ground pools less than 24 inches deep that do not exceed 5,000 gallons may be exempt from building permits under CVMC 15.06.080. Larger above-ground pools require permits and must meet pool barrier requirements. All pools must comply with California safety standards.
Under CVMC section 15.06.080 and the California Building Code, prefabricated swimming pools accessory to residential dwellings that are less than 24 inches deep, do not exceed 5,000 gallons, and are installed entirely above ground may be exempt from building permit requirements. Larger above-ground pools or those deeper than 24 inches require a building permit. All pools regardless of size must comply with pool barrier requirements under CVMC Chapter 15.48 and California Health and Safety Code section 115920 β at least two of seven approved safety features are required. Above-ground pools must maintain zoning setbacks from property lines. Pool water discharge must comply with stormwater regulations and should not be drained into the storm drain system if chlorinated. Electrical connections for pool pumps and equipment must comply with the National Electrical Code and require electrical permits.
Pools installed without required permits are subject to code enforcement. Safety barrier violations are prioritized due to drowning risk. Unpermitted electrical work is a serious safety violation.
