Above-ground swimming pools in Durham are subject to the same permitting and safety requirements as in-ground pools. The pool must maintain a minimum 5-foot setback from all property lines and may not be located between the street and the primary dwelling per UDO Section 5.4.9. Pool barrier fencing of at least 48 inches in height is required per the NC Building Code. If the above-ground pool walls are at least 48 inches tall, they may serve as part of the barrier, but all access points including ladders and decks must still have self-closing and self-latching gates or removable ladder systems. The VGB Act requires compliant drain covers on all pools regardless of type.
