Denton County, TX Swimming Pools & Spas: Above-Ground Pools (2026)

Denton County treats above-ground pools the same as in-ground pools for safety and permitting purposes when they are capable of holding water 18 inches or deeper. Under Texas Health and Safety Code Chapter 757, the pool structure itself can serve as part of the required barrier if the pool walls are at least 48 inches above the adjacent grade on all sides. Any ladder, steps, or ramp providing access to the pool must be removable, lockable, or surrounded by a barrier that meets the 48-inch height requirement with a self-closing, self-latching gate. Inflatable pools and temporary wading pools under 18 inches of water depth are generally exempt from barrier requirements but must still be emptied when not in use for mosquito and safety reasons. Cities within Denton County, such as Flower Mound and Highland Village, may have additional zoning setback requirements that dictate how far the pool must be from property lines and structures. Electrical connections for above-ground pool pumps and filters require GFCI protection and must be installed by a licensed electrician or inspected under a building permit.
