Texas Health and Safety Code Chapter 757 establishes statewide minimum pool enclosure standards that apply throughout Denton County. Gates must be self-closing and self-latching, with latches placed at least 54 inches above grade on the exterior or equipped with a key lock or combination lock. Chain-link fencing must have no more than 1.75-inch diamond openings. Horizontal rails or other climbable elements are prohibited on the exterior side of the fence. The barrier must not have openings that allow passage of a 4-inch sphere. The wall of a dwelling may serve as part of the barrier if all doors providing direct pool access have self-closing devices and alarms compliant with UL 2017. Denton County requires pool barrier compliance before final inspection approval for new construction. Existing pools that undergo substantial renovation must also be brought into compliance. Building permit applications for pools must include a site plan showing the proposed barrier location and specifications.
Failure to maintain compliant pool fencing can result in code compliance violations with fines up to $500 per day. Stop-work orders may be issued during construction if barriers are not installed before filling the pool. Cities within the county can require corrective action within 30 days.
