Texas Health and Safety Code Chapter 757 sets the statewide baseline for swimming pool enclosures that Denton enforces through its building code. All residential swimming pools, hot tubs, and spas capable of holding water 18 inches or deeper must be enclosed by a permanent barrier at least 48 inches high as measured from the exterior finished grade. Gates must be self-closing and self-latching with latches positioned at least 54 inches above grade on the exterior side or equipped with a key lock or combination mechanism. Chain-link fencing used as a pool barrier must have openings no larger than 1.75 inches measured diagonally. The barrier must not have horizontal rails or other climbable features on the exterior face, and no opening may allow passage of a 4-inch diameter sphere. The wall of a dwelling may serve as part of the pool barrier provided that all doors with direct pool access are equipped with self-closing devices and audible alarms meeting UL 2017 standards. The Denton Development Services Department requires a pool barrier plan as part of building permit applications, and barriers must be in place before the pool is filled and before final inspection approval is granted. Removable mesh fencing meeting ASTM F2286 may be used as a supplemental barrier but does not replace permanent fencing requirements.
Failure to install or maintain compliant pool fencing can result in code enforcement citations with fines up to $500 per day per violation. Stop-work orders may be issued if barriers are not installed before pool filling. Repeat violations may result in permit revocation.
