Little Elm enforces pool enclosure standards through the 2018 International Residential Code Appendix G, Section AG105, and the International Building Code Section 3109.4 through 3109.4.1.9 for commercial or public pools. Texas Health and Safety Code Chapter 757 establishes statewide minimum pool barrier requirements throughout Denton County. Barriers must be at least 48 inches high measured from the exterior finished grade. Gates must be self-closing and self-latching, with latches placed at least 54 inches above grade on the exterior side or equipped with a key lock or combination lock. Openings in the barrier must not allow passage of a 4-inch diameter sphere. Horizontal rails or other climbable elements are prohibited on the exterior face of the fence. When the dwelling wall forms part of the barrier, all doors providing direct pool access must have self-closing devices and alarms compliant with UL 2017 standards. Temporary fencing is required at all times during construction until permanent barriers are installed. Building inspection is required before the pool may be filled. Many Little Elm HOAs impose additional architectural requirements for pool fencing materials and appearance.
Failure to install compliant pool fencing results in denial of final building inspection and inability to fill the pool. Code violations carry fines up to $500 per day per offense. Each day of non-compliance constitutes a separate violation.
