The Town of Oro Valley treats above-ground pools similarly to in-ground pools for barrier and safety purposes. Under ARS 36-1681, any above-ground pool capable of holding water to a depth of 18 inches or more must have a compliant barrier system. If the pool wall is at least 5 feet high from the surrounding grade and the ladder or entry system can be locked, removed, or secured to prevent unauthorized access, the pool wall itself may satisfy the barrier requirement. If the pool wall is less than 5 feet, a supplemental fence or barrier must be installed to reach the 5-foot minimum. Inflatable and temporary pools exceeding 18 inches in depth are subject to the same rules. A building permit is generally required for permanent above-ground pool installations that involve electrical connections, plumbing, or attached decking. Small seasonal pools that are filled and drained manually and do not have permanent electrical connections may be exempt from building permits but are not exempt from barrier requirements. The pool must maintain the minimum setback from property lines, typically 5 feet. Decking attached to or surrounding the above-ground pool must not provide a means to bypass the barrier. HOA communities in Oro Valley may prohibit above-ground pools entirely through their CC&Rs.
