The Town of Oro Valley regulates hot tubs and spas under its building code and ARS 36-1681. Any spa or hot tub capable of holding water deeper than 18 inches requires a compliant barrier system. When the cover is removed during use, the spa must be within a fenced area or under direct adult supervision. A building permit is required for permanent hot tub installations that involve electrical wiring (typically 240V dedicated circuit), gas connections, or plumbing tied into the home drainage system. Electrical installations must comply with the National Electrical Code, including GFCI protection on the dedicated circuit and proper bonding of the spa shell and surrounding conductive surfaces. Portable plug-in hot tubs operating on a standard 120V circuit and not permanently plumbed may not require a building permit but must still comply with barrier and electrical safety requirements. Setbacks from property lines apply, typically 5 feet minimum. Hot tubs must not discharge water onto neighboring properties or into the public right-of-way. Water temperature must not exceed 104 degrees Fahrenheit per manufacturer guidelines and industry safety standards.
