Above-ground pools in San Bernardino over 18 inches deep follow the same permit and barrier rules as in-ground pools. Pool walls of 60 inches can serve as the barrier when steps or ladders are locked or gated.
Many Inland Empire homes use above-ground pools to beat the summer heat, but California law does not distinguish between in-ground and above-ground for safety purposes. Under Health and Safety Code 115921, a swimming pool is any structure intended for swimming or recreational bathing that contains water over 18 inches deep, which captures most soft-sided and steel-wall above-ground pools. San Bernardino requires a building permit for installation, plus electrical permits for pumps and heaters. The pool wall itself can count as part of the barrier if it is at least 60 inches tall and rises directly from the ground without climbable structures within three feet. Where the wall is shorter or access is via steps or a ladder, a separate 60-inch barrier must enclose the pool or the steps must include a locking cover or self-closing gate with a latch at least 60 inches above the deck. Removable mesh fencing meeting ASTM F2286 is a popular option. The deck and ladder structure require plan review for structural stability, and electrical bonding to the pool metal frame is mandatory under the California Electrical Code. Seasonal pools taken down each winter still need a permit if they hold more than 18 inches of water. Unpermitted installation is grounds for a stop-use order from Code Enforcement.
