California Health and Safety Code sections 115920 through 115929 (Swimming Pool Safety Act) apply to all new residential pools and spas in San Bernardino. A compliant barrier must be at least 60 inches high measured from the outside, have openings no more than four inches wide, and include a self-closing and self-latching gate with the latch at least 60 inches above the ground. Since 2018 the law requires at least two of seven listed drowning-prevention features: qualifying enclosure, removable mesh fence, approved safety cover, exit alarms on doors leading to the pool, self-closing and self-latching devices on these doors, alarms on the pool itself, or other feature approved by ASTM. The CBC and San Bernardino Municipal Code Title 15 adopt these provisions. Sales of homes with pools trigger a disclosure and compliance inspection under Health and Safety Code 115925. Above-ground pools over 18 inches also require barriers.
