California Health & Safety Code §115922 (Swimming Pool Safety Act, amended by SB 442) preempts local rules. New or remodeled residential pools must have at least two of seven drowning prevention safety features, one of which is an enclosure meeting HSC §115923. Under California Health & Safety Code §115922 (as amended Stats. 2024 Ch. 769, effective Jan. 1, 2025), when a building permit is issued for a new pool/spa or for remodeling an existing pool, the property must be equipped with at least two of seven drowning prevention safety features. Acceptable features include: (1) an enclosure meeting HSC §115923 that isolates the pool from the home, (2) removable mesh fencing meeting ASTM F2286 with a self-closing/self-latching gate, (3) ASTM F1346-23 safety pool covers, (4) exit alarms on doors/windows providing direct pool access, (5) a self-closing/self-latching device with release no lower than 54 inches above the floor on doors leading to the pool, (6) ASTM F2208 water immersion alarms, and (7) other approved means. An enclosure under §115923 must be at least 60 inches tall, have maximum 4-inch gaps, and include self-closing/self-latching gates that open outward from the pool. Rialto enforces compliance through Building & Safety plan check (909-820-2505).
Failure to install required SB 442 safety features is a violation of state law and Rialto Code Title 15. Pools constructed without compliant barriers cannot pass final inspection; permits will not close. Non-compliance creates civil drowning liability exposure and may trigger code enforcement action through Community Compliance.
