Above-ground, portable, inflatable, and collapsible pools holding water over 18 inches deep are subject to the same 5-foot barrier fencing rules as in-ground pools in Rialto. The pool's own walls can serve as the barrier only if they are at least 5 feet high and meet all barrier standards, with ladders that lock, are removable, or are fenced.
Rialto's Building & Safety pool fencing handout defines swimming pools to include without limitation all portable, moveable, collapsible, storable and permanent in-ground, above-ground and on-ground swimming pools holding water over 18 inches deep. Fencing requirements for above-ground pools are the same as for other pools unless the pool's side walls themselves form a complying barrier equivalent in height (5 feet) and meeting all minimum barrier requirements, including climb resistance and opening limits. Where the pool structure serves as the barrier or the barrier is mounted on top of the pool and access is by ladder or steps, the ladder or steps must either be capable of being secured, locked, or removed to prevent access, or be surrounded by their own complying barrier; any opening created when the ladder is removed must also be protected. The bottom-of-barrier clearance may be increased to 4 inches where the barrier is mounted on top of the above-ground pool structure. RMC 15.36.010 separately sweeps in any water storage facility more than 12 inches deep that is regularly used as a swimming pool.
An unfenced above-ground pool deeper than 18 inches is a violation subject to RMC 1.16.010 penalties (misdemeanor up to $1,000 and/or six months, or infraction fines of $100/$200/$500) and administrative fines of $100 to $1,000 per day under RMC Chapter 1.10.
