San Ramon enforces the 2022 California Building Standards Code for residential pool installations and exempts only small prefabricated above-ground pools from the building permit (less than 24 inches deep, or accessory pools with capacity not exceeding 5,000 gallons); an electrical permit is still required for all prefabricated pool equipment. Above-ground pools are accessory structures under Zoning Ordinance D4-26 and follow its setback rules: 18 inches or less in height needs no setback, more than 18 inches up to 6 feet needs a 3-foot side and rear setback, and over 6 feet uses height-minus-3-feet. State law layered on top requires at least two of seven approved drowning-prevention features under California Health and Safety Code Sections 115921 to 115929 (the Pool Safety Act, expanded by SB 442 effective January 1, 2018), including a compliant 60-inch enclosure.
Building permits for swimming pools in San Ramon are issued by the Building and Safety Services Division (City Hall, (925) 973-2500), which applies the 2022 California Building Code, California Electrical Code, California Plumbing Code, California Mechanical Code, California Energy Code, and California Fire Code. Two narrow building-permit exemptions apply to prefabricated above-ground pools: pools less than 24 inches deep, and prefabricated pools accessory to a residence whose pool walls are entirely above adjacent grade and whose water capacity does not exceed 5,000 gallons. An electrical permit is required for ALL prefabricated pool equipment regardless of permit exemption. Setbacks for above-ground pools fall under San Ramon Zoning Ordinance Section D4-26 (Accessory Structures): if the structure is 18 inches or less in height, no side or rear setback is required; if it is greater than 18 inches but 6 feet or less in height, a three-foot side and rear setback is required; if it is greater than 6 feet in height, the setback equals the height less three feet. Front-yard setback rules follow D3-10 (Setback Requirements and Exceptions) and D3-37 (Driveways and Site Access). General fence rules separately allow a seven-foot fence with the top one foot of open lattice on rear and side property lines, and up to three feet within the front yard setback area. State law layered on top: the California Swimming Pool Safety Act, codified at Health and Safety Code Sections 115921-115929 and expanded by SB 442 effective January 1, 2018, requires that any new or remodeled residential pool at a single-family home include at least two of seven approved drowning-prevention safety features. Approved features include an enclosure that meets the standards of Section 115923 (at least 60 inches high, no climbable features, gaps no greater than 4 inches, self-closing and self-latching gate that opens outward); removable mesh fencing; an approved safety pool cover meeting ASTM F 1346; exit alarms on doors that lead to the pool; self-closing and self-latching devices on doors providing direct pool access; pool alarms meeting ASTM F 2208; and other means of protection providing equal or greater protection. Home inspectors must list which features are present in the home inspection report at sale.
Installing or maintaining an above-ground pool without required building or electrical permits, in the wrong setback, or without a complying enclosure can lead to stop-work orders, retroactive permitting, code-enforcement abatement, and required removal. New or remodeled pools that fail to provide two qualifying SB 442 features under Health and Safety Code 115922 can be denied final inspection and create civil liability if a drowning occurs.
