Walnut Creek requires a building permit for above-ground swimming pools unless the prefabricated pool's walls are 24 inches or less and capacity is 5,000 gallons or less. Pools must be enclosed by a minimum 54-inch fence with a self-latching gate, and the California Pool Safety Act (Health & Safety Code 115921 et seq., SB 442) requires at least two of seven approved drowning-prevention features at any new or remodeled residential pool.
Walnut Creek's Building Permit FAQ exempts a prefabricated residential swimming pool from a building permit only when the walls are 24 inches high or less and capacity is 5,000 gallons or less; any larger above-ground pool requires a building permit through the Walnut Creek Permit Center. Permit review applies the current California Building Standards Code, including the California Residential Code, the California Plumbing Code, and the California Electrical Code. Walnut Creek's published fencing standard requires that any swimming pool be surrounded by a fence at least 54 inches tall with a self-latching gate, or by a wall that meets the same access-prevention standard, and the fence must comply with the California Building Code or California Residential Code as applicable. The wall of a stock above-ground pool does not by itself satisfy the enclosure rule unless its design meets these standards (no climbable features, gaps no larger than 4 inches, and a self-closing, self-latching gate opening away from the pool). State law layers on top: California Health and Safety Code Sections 115921 to 115929, expanded by SB 442 effective January 1, 2018, requires that any new or remodeled residential pool or spa at a single-family home include at least two of seven approved drowning-prevention features, including an enclosure at least 60 inches tall, removable mesh fencing meeting ASTM F2286, an ASTM F1346 safety pool cover, exit alarms on doors leading to the pool area, self-closing and self-latching doors, swimming-pool alarms meeting ASTM F2208, or other equivalent features defined by statute. Home inspectors must note in transfer disclosure reports which of these features are present at sale. Electrical bonding and GFCI protection per CEC Article 680 still apply to above-ground pool pumps, lighting, and motors regardless of the size exemption.
Installing an above-ground pool over 24 inches deep or over 5,000 gallons without a permit, or without a compliant 54-inch enclosure and self-latching gate, can trigger code enforcement, stop-work orders, retroactive permitting fees, and required removal. Failure to provide two SB 442 safety features at a new or remodeled pool can block final inspection and create civil liability if a drowning occurs. Unpermitted electrical work on pool equipment violates CEC 680 and is a separate citation.
