Above-ground pools over 18 inches deep are subject to the same California Swimming Pool Safety Act barrier requirements as in-ground pools. Removable ladders that lock may satisfy some barrier requirements. Small kiddie pools under 18 inches are exempt.
CA H&S Code Β§115921 applies to all private pools over 18 inches in depth, including above-ground pools. Above-ground pools with lockable or removable ladders may use the ladder removal as part of a compliant barrier system, but the pool walls alone must be at least 48 inches high as measured from the outside ground level, or a separate compliant fence must be provided. For post-2018 pools, a second safety feature is still required. Small wading/kiddie pools under 18 inches in depth are exempt from fencing requirements but should be emptied when not in use and supervised. Contact Tracy Building Safety (209-831-6400) for permit requirements based on pool size.
