3250(h), part of the City's wall, fence and hedge chapter, sets a dedicated barrier standard for swimming pools separate from the general fence height rules that apply elsewhere in that same section (an 8-foot maximum on most of a lot, 6 feet on a public easement, and 3 to 4 feet in a required front yard). Subsection (h) requires that all swimming pools authorized by building permit after the ordinance's effective date be enclosed by a fence that is substantial in construction, at least 5 feet high, and built with no openings greater than 3 inches when all gates are closed.

Gates 5 feet wide or less must be self-closing and self-latching; gates wider than 5 feet must have some other means of latching closed. Every latch on an enclosing gate must sit at least 4 feet above grade. Critically, no pool may be filled with water until the enclosing fence is both constructed and approved by the Chief Building Official, tying the barrier requirement directly to the certificate-of-occupancy or final-inspection process rather than leaving it to voluntary compliance. The section allows an existing structure, fence, or gate already on the property to substitute for a new pool fence if the Chief Building Official determines it independently satisfies every element of subsection (h), so a fully enclosed yard with a compliant perimeter fence does not necessarily require a second, pool-specific barrier.

The pool fencing rule was added by Ordinance 1077 in 2005, building on the broader fence and hedge standards first codified in Ordinance 1010 (1999) and Ordinance 1023 (2001).
