Desoto County, MS Swimming Pools & Spas: Fencing Requirements (2026)

DeSoto County, MS mandates pool barrier fencing under building codes adopted pursuant to MS Code Ann. §17-1-1 et seq. and MS Code Ann. §45-11-1 et seq. (State Fire Marshal's role in life safety). Southaven, Olive Branch, Horn Lake, and Hernando have all adopted the International Residential Code Appendix G and the International Swimming Pool and Spa Code, which together establish the baseline barrier requirements. Barriers around any pool holding 24 inches or more of water must be at least 48 inches (4 feet) in height measured from the outside grade, with no climbable horizontal features. Openings in the barrier cannot exceed 4 inches (reduced to 1.75 inches where picket spacing is above any horizontal member within 45 inches of grade). Pedestrian gates must open outward away from the pool, be self-closing and self-latching, with the release mechanism located at least 54 inches above the ground on the pool side or otherwise protected from small children. The barrier must completely enclose the pool area with no direct unprotected access from the dwelling. Doors opening from the house to the pool enclosure must have either an audible alarm, a power safety cover, or a self-closing/self-latching device compliant with IRC §AG105.3. Above-ground pools with walls at least 48 inches tall may use the pool wall as part of the barrier with a lockable or removable ladder. Pre-use inspections are required before the pool is filled or used. Mississippi's warm climate and long swim season means barrier compliance is critical year-round. HOAs may impose additional pool fencing aesthetic standards.
