In unincorporated DuPage County, any pool, spa, or hot tub 24 inches deep or larger, 250 square feet or larger, or with a recirculating system must be enclosed by a 48-inch non-climbable fence with self-closing, self-latching gates. The rule is enforced under the DuPage County Building Code (Article XIII, Sec. 8-1300, adopting the 2021 International Swimming Pool & Spa Code).
The DuPage County Building & Zoning Department applies the County Building Code's adopted standards to every pool, spa, or hot tub in unincorporated DuPage that is at least 24 inches deep, has at least 250 square feet of surface area, or is equipped with a water-recirculating system. The County's "Swimming Pools/Spas/Hot Tubs" permit guide (9/25/2024) requires a 48-inch high non-climbable fence around the pool area or yard with self-closing, self-latching gates. If the pool walls are 48 inches above grade at all points, a removable lock-up ladder may be used in place of a yard fence; hot tubs may instead use a rigid locking cover. The County references three adopted standards: 2021 International Building Code (Article VII, Sec. 8-700), 2020 National Electrical Code (Article VI, Sec. 8-600), and 2021 International Swimming Pool & Spa Code (Article XIII, Sec. 8-1300). A permit is required before installation, with a Plat of Survey, construction plans, and contractor registration submitted via the Accela portal.
Installing a pool without a permit or without a code-compliant barrier in unincorporated DuPage County is a Building Code violation. The Building Division (630-407-6700) may issue stop-work orders, deny final inspection, and refuse to release the Performance Bond. Continued non-compliance can result in code-enforcement action and fines under the DuPage County Code.
