Horace Title V Ch. 5-01 adopts the North Dakota State Building Code (NDSBC), which incorporates the 2021 IRC Appendix G/AG105 swimming-pool barrier standards: barriers at least 48 inches above grade with self-closing, self-latching gates. Horace has no separate local pool ordinance.
Horace Code Β§5-0101 ("Adoption of State Building Code") makes the NDSBC controlling for all construction in the City and its extraterritorial zoning jurisdiction. The NDSBC effective Jan. 1, 2023 adopts the 2021 IRC, including Appendix G (Swimming Pools, Spas and Hot Tubs). Section AG105 sets the residential barrier rules: 48-inch minimum height, no openings allowing a 4-inch sphere to pass, and self-closing/self-latching gates with the latch on the pool side when below 54 inches. Horace amendments in Β§5-0102 do not modify Appendix G. Building permits and inspections are administered by the City Building Administrator under Β§5-0102 and Β§5-0105 (Appeals to City Council).
Violations of any provision of the adopted Building Code are infractions under Β§5-0103, with penalties under Β§1-0211; each day of non-compliance is a separate offense. Permits and inspections are required through the Building Permits and Inspections department.
