Gates must open outward away from the pool, be self-closing, and self-latching; the latch must be at least 54 inches above grade or located on the pool side with shielding. A dwelling wall may form part of the barrier if doors leading to the pool have audible alarms or self-closing/self-latching hardware. Above-ground pools with walls at least 48 inches may use the pool wall as the barrier if access ladders are removable or lockable. Saratoga Springs, Clifton Park, Halfmoon, Malta, and Ballston Spa all inspect barriers at final. Non-climbable construction required โ horse-farm split-rail fences typically do NOT qualify without added mesh.
Non-compliant barrier: cannot pass final inspection; pool may not be filled. Post-occupancy violations: $250 to $1,000 plus 30-day correction order. Drowning liability exposure significant under NY GOL ยง5-322.1.
