Section 4-03-03-02-15 of the county's Development Standards and Regulations sets the barrier rule for private pools on unincorporated land. Pre-existing pools had to be fenced within six months of the regulation's adoption. Public and semi-public pools follow the stricter state rule (5 CCR 1003-5 Section 3.24): a 60-inch fence with self-closing, self-latching gates and a latch at least 54 inches high. Inside cities, the city's adopted building code governs.
Operating or maintaining a pool without a compliant enclosure violates the Development Standards and Regulations and is subject to county code enforcement.
