Middlesex County, NJ has no county-level pool fence rules. Pool barriers are governed by the NJ Uniform Construction Code (N.J.A.C. 5:23-3.14) which adopts the International Swimming Pool and Spa Code (ISPSC) as the NJ Swimming Pool and Spa Subcode. New Jersey regulates residential pool fencing statewide through the Uniform Construction Code Act (N.J.S.A. 52:27D-119 et seq.) and its implementing regulations at N.J.A.C. 5:23. N.J.A.C. 5:23-3.14 adopts the International Swimming Pool and Spa Code (ISPSC), as amended, as the NJ Swimming Pool and Spa Subcode. The ISPSC applies to any pool, hot tub, or spa with water depth of 24 inches or more, including in-ground, above-ground, on-ground, and seasonal pools. Under ISPSC Section 305 (Barrier Requirements), barriers must be at least 48 inches above grade on the side away from the pool, with a maximum 2-inch gap between the bottom of the barrier and the ground (or 4 inches over a non-solid surface). Openings in the barrier may not allow the passage of a 4-inch-diameter sphere. Where horizontal members are spaced less than 45 inches apart, vertical members may not be more than 1.75 inches apart; where horizontals are 45 inches or more apart, vertical spacing may not exceed 4 inches. Gates must open outward away from the pool and be self-closing and self-latching; if the latch release is below 54 inches, it must be on the pool side of the gate. Where a wall of the dwelling forms part of the barrier, doors with direct pool access must have an audible alarm or be equipped with a self-closing/self-latching device or a power safety cover (ISPSC 305.4). Permits and inspections are handled by the Construction Official of each Middlesex County municipality (New Brunswick, Edison, Perth Amboy, Woodbridge, Piscataway, etc.) β Middlesex County does not issue UCC permits.
Installing or filling a pool without a code-compliant barrier violates the NJ UCC (N.J.A.C. 5:23) and the ISPSC. Under N.J.S.A. 52:27D-138, civil penalties of up to $2,000 per violation may be imposed, and each day a violation continues can be treated as a separate offense. The municipal Construction Official can issue stop-work orders, withhold the certificate of approval, and require corrective work before pool use. Civil liability for drowning or injury caused by a non-conforming barrier follows NJ premises-liability law and may not be covered by homeowners insurance if the barrier was non-compliant.
