The barrier rules align with the NJ-adopted ISPSC pool-barrier code under N.J.A.C. 5:23-3.14 and IRC Appendix G. The Edison Construction Code Official verifies barrier compliance during the UCC final inspection before issuing a certificate of approval, and the Health Officer re-verifies barrier condition at each annual license renewal.
Operating a pool without a compliant 4-foot lockable barrier is a Chapter 17 violation. Penalties include a stop-use order requiring the pool to be drained, license suspension or revocation by the Health Officer, daily fines under the Township general penalty schedule, and exposure to civil liability under New Jersey premises law if a drowning or near-drowning occurs.
