Gates must be self-closing and self-latching with latches at least 40 inches above grade. Above-ground pools may use removable ladders combined with compliant barriers.
NYS Uniform Code Appendix G (effective May 12, 2020) sets the floor for all residential pool barrier requirements in Rockland County. Minimum 48-inch barrier height measured from grade outside the enclosure; maximum 2-inch opening at the bottom; openings in the barrier must not allow passage of a 4-inch sphere. Gates open outward from pool, self-close and self-latch, latch on pool-side at least 40 inches above grade. Where a dwelling wall is part of the barrier, any door leading to the pool must have an audible alarm. Pool alarms are required per NY Executive Law 387(14) for pools built or modified after Dec 14, 2006 and must meet ASTM F2208. Rockland towns inspect barrier compliance before issuing a pool certificate of compliance. Temporary 48-inch construction barrier is mandatory during installation until the permanent fence is complete, within 90 days. HOA declarations in Rockland communities may require additional screening or landscape softening.
NYS pool barrier noncompliance: fines up to $5,000 per day and possible misdemeanor charges. Pool alarm signage violations: $500 first offense, $1,000 subsequent. Denied certificate of compliance prevents legal use.
